RELIEVING NON PERFORMING OFFICIALS 

(a) whether the Government has taken any decision to relieve retire non-performing officers of All India Services Central Government from service; 

(b) if so, the details thereof, with relevant provisions for the last three years; 

(c) whether the Government has devised any new methodology to identify non-performing officers; and

  (d) if so, the details thereof? 

ANSWER

(a) & (b): In so far as the All India Service Officers are concerned, rule 16(3) of the All India Services (DCRB) Rules, 158 has been amended on 31st January, 2012 which provided that the Central Government may, in consultation with the State Government concerned, require a Member of the Service to retire from Service in public interest, after giving such Member at least three months previous notice in writing or three months pay and allowances in lieu of such notice:- 

 (i) after the review when such Member completes 15 years of qualifying Service: or:   

(ii) after the review when such Member completes 25 years of qualifying Service or attains the age of 50 years, as the case may be; or 

 (iii) if the review referred to in (i) or (ii) above has not been conducted, after the review at any other time as the Central Government deems fit in respect of such Member. 

 So far as Central Government Employees are concerned, Government may retire a Government Servant in public interest after he has attained the age of 5055 years or after completion of 30 years service by giving him notice of not less than three months in writing of three months pay and allowances in lieu of such notice. 

Since the rule 16(3) of AIS (DCRB) Rules, 158 has been amended recently on 31.01.2012, no officer has been retired prematurely in public interest invoking the amended provision of the rules. However, All India Service officers have been retired prematurely in public interest in the past invoking the pre-amended rule 16 (3) of AIS (DCRB) Rules, 158 after completion of 30 years of qualifying service or 50 years of age. 

 (c) & (d): A member from outside the StateCadre and a member belonging to SCST community have been included in the review committee for All- India Service Officers.
