WRONG TAX DEMAND 

1730. SHRI ANANTKUMAR HEGDE: 

Will the Minister of FINANCE be pleased to state:

(a) whether the Government is aware of the ruling by Bombay High Court in favour of assessee against Income Tax Department regarding wrong tax demand by IT officials; and

(b) if so, the details thereof and the action taken thereon against the erring IT officials?

(a) Hon’ble Bombay High Court has given rulings in a large number of cases arising out of disputes in the course of administration of the Income-tax Act, 1961, wherein Income Tax Department is a party. Many of such rulings are in favour of the Income Tax Department while others are in favour of the tax payers.

(b) Depending upon facts of specific cases, appropriate action against officials found guilty of misconduct is taken as per the extant rules.
